Philosophy of Law
Introduction
Since the sixties Porfirio Miranda began to elaborate the seed of what would become his four handwritten notebooks on the Philosophy of Law which he began in 1981 while he was in the process of publishing his book ‘I Appeal to Reason’.
In the first notebook, for example, Porfirio puts forward the fundamental theses which he defends all through the notebooks without losing the unity shown in all of Miranda’s works. At the beginning he says that:
“In one go all traditional theses that affirm the essential difference between morality and law are nonsense. To sustain that morality has as an end auto-perfectionism of an obligated subject is to ignore the essence of the moral imperative, which is characterized as not being the means for something else, as it is not a conditional imperative. And it is to ignore, at the same time, the essential argument from which comes the moral imperative. To say that the law sees the relationship between subjects and morality is to fail the only point of what is moral. The precepts that do not refer to the other are not authentically moral.”
It should be mentioned that Porfirio Miranda was professor of Philosophy of Law at UNAM from 1973 to 1974. The handwritten legacy are 8 notebooks on Hegel’s philosophy and 17 on the Philosophy of Science apart from the notebooks on theology, on Marx and those on Marx-Engels.
The RORAC Foundation, through the Jose Porfirio Miranda Centre for Philosophic Studies, is to make Jose Porfirio Miranda’s work known and to back research by contemporary philosophers. The decision to scan the manuscripts was based on the idea that the spirit of Jose Porfirio Miranda’s research was to transmit exact copies of the texts of his collection in a universal format.
